SMS/MMS Terms and Conditions

Agreement

By opting in to receive SMS or MMS messages from Vitality Restoration Medical LLC (“we,” “us,” “our”) through our toll-free or A2P 10DLC numbers, you agree to these Terms and Conditions (“Terms”) and our Privacy Policy at https://contact.vitalityrestorationmedical.com/privacy-policy.

These Terms comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles, HIPAA, and carrier requirements for healthcare-related A2P messaging.


Services

We use SMS/MMS messaging to send important updates related to your care, including:

1-Appointment reminders

2-Wellness or treatment check-ins

3-Post-treatment follow-ups

(typically 1–4 messages per month)

Messages are strictly for treatment and wellness communication.
Marketing or promotional messages are only sent if you provide separate, explicit consent.
Standard message and data rates may apply.


Eligibility and Consent

To participate in our messaging program, you must:

1-Be 18 years or older

2-Be a resident of the United States or Canada

3-Be a patient or authorized representative of Vitality Restoration Medical LLC

You must give explicit consent to receive messages (e.g., through an unchecked checkbox stating:

“I consent to receive SMS communications from Vitality Restoration Medical LLC. Msg & data rates may apply. Reply STOP to cancel.”)

We securely store all opt-in records as required by law. You may revoke consent at any time (see Opt-Out below).


Opt-In and Opt-Out

Opt-In:
Consent is collected via web forms, paper forms, or verbal agreement during patient intake, with links to these Terms and our Privacy Policy.

Opt-Out:
To stop receiving messages, reply “STOP” to any SMS. We will send a one-time confirmation and stop further communications.
To resume receiving messages, you must opt in again.

Your Responsibilities

By using our SMS/MMS services, you agree to:

Provide an accurate, active mobile phone number.

Notify us promptly if your contact information changes.

Use our SMS services lawfully and not for any prohibited or illegal purposes.

We may monitor SMS communications to ensure compliance with these Terms and applicable regulations.


Data Handling

We limit the use of protected health information (PHI) in SMS/MMS communications to the minimum necessary, per HIPAA guidelines.
Your information is not sold or shared for marketing purposes.

Data may only be shared with:

Service providers (e.g., HIPAA-compliant platforms such as Go High Level) under Business Associate Agreements (BAAs)

Legal authorities when required by law

Disclaimers and Liability

SMS/MMS services are provided “as is,” without warranties of any kind.

We are not liable for delays, message delivery failures, or issues caused by carriers or third-party service providers.

You indemnify and hold harmless Vitality Restoration Medical LLC and its affiliates from any claims or damages arising from misuse of our messaging services.

We reserve the right to suspend or terminate messaging services for non-compliance with these Terms.


Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida.
Any disputes arising under these Terms will be resolved through binding arbitration in Miami, Florida, in accordance with the American Arbitration Association (AAA) rules, except where prohibited by law.


Changes to Terms

We may update these Terms periodically to reflect regulatory or operational changes.
